By accessing and using our website, you agree to comply with the following General Conditions, which outline the terms under which our services are provided. These terms are governed by Cuban law. Please, you are welcome to register. Once you have registered, and we verify the information provided, users will be approved and will then be able to log in and view the services we will offer.
2. Services Offered
We offer a variety of travel services in Cuba, including:
– Accommodation bookings
– Ground transportation
– Guided tours
– Event and conference management
– Tailor-made travel packages
– Tourist cards
– Travel Insurance
Each service is described in detail on our website. Additional services can be provided upon request, subject to availability and extra costs.
3. Booking and Payment Terms
3.1 – Booking Process: Bookings can be made through our website, via email, or by whatsapp. All bookings are subject to availability and will be confirmed via email.
– Payment Methods: We accept payment via major credit cards, wire transfers, and other locally accepted methods. All payments are processed in UK Pounds (GBP), unless otherwise stated. Credit card payments may be subject to a surcharge. If so, this will be specified on the order page.
3.2 – Payments made using non-GBP credit or debit cards will be by default converted from GBP by our dynamic currency conversion service provider. If you would like your card company to do the currency conversion, please let us know in advance.
– Deposits: A non-refundable deposit of [XX]% is required at the time of booking to confirm the reservation.
– Final Payment: The remaining balance must be paid [XX] days before arrival.
3.3 – Cancellation Policy:
3.3.1 Refunds and changes by you:
If you cancel a reservation (or part of) after our acceptance of your booking and payment has been taken and the credited funds have cleared and it is more than 72 hours before the arrival date we will refund you the total amount for that reservation (or cancelled part) minus 15% (or 25.00 GBP whichever is the greater) to cover administration costs. If you cancel a reservation (or part of) after our acceptance of your booking and payment has been taken and the credited funds have cleared and it is less than 72 hours before the arrival date we will refund you the total amount for that reservation (or cancelled part) minus 15% (or 25.00 GBP whichever is the greater) to cover administration costs and the amount of the first night to cover no-show charges. If you cancel a reservation (or part of) on or after the arrival date no claim for any refund can be accepted.
3.3.1.2 Should we refund money to you, we reserve the right to deduct our direct costs of making such payments. This might amount to 17.00 GBP for an international bank transfer.
3.3.1.3 Cancellation requests are required in writing by post, fax or email. Until then, you are liable for the full amount.
3.3.1.4 After our acceptance of your room reservation(s) it may be possible for you to make non-cancellation type modifications but you will be charged £25.00 GBP for each reservation change.
3.3.1.5 If you make a change to your booking less than 72 hours before the arrival date, the amendment fee is 50.00 GBP.
3.3.1.6 Request for any change in your booking is required in writing by whatsapp or email.
3.3.1.7 We will always try not to be unreasonable in the implementation of our conditions.
3.3.2 Cancellations, refunds or changes by us:
3.3.2.1 We aim not to make any changes to your reservations but arrangements are often made many months in advance with our suppliers over whom we have no direct control and changes may be necessary. Most changes will be minor and although we will endeavour to advise you of any minor changes before your arrival date, we have no obligation to do so and will not pay any compensation. We will endeavour to advise you of a major change before your arrival date, a major change is defined as a significant change of resort or a change of accommodation to that of a lower official category.
3.3.2.2 In the event that the booking with us has been completed and the cleared funds credited to our bank account, and you are advised of a major change before your arrival date we will provide you with the three following options:
a) Accept the alternative arrangements which we may offer OR
b) Purchase another accommodation from us, which if more expensive you will have to pay the difference, but if cheaper we will refund the difference OR
c) Cancel the reservation and receive a total refund of all monies paid to us.
Whichever of the three options is accepted we will also pay you compensation of 15.00 GBP and there will be no further liability.
Important Notice: Compensation will not be paid for situations beyond our control. Examples of situations beyond our control include but are not limited to war or threat of war, civil strike, industrial disputes, government resolutions or decrees that disrupt normal operations, natural disaster, regional disruption of basic utilities, bad weather, terrorist activity, transfer rescheduling or cancellation, technical or maintenance problems with transport.
4. Pricing and Currency
– Prices are displayed in UK Pounds (GBP) and may also be provided in USD. Exchange rates may fluctuate, and final prices in foreign currency will be calculated based on the prevailing rate at the time of payment.
– Additional taxes, including local taxes, service fees, and government-imposed charges, may apply and will be clearly communicated at the time of booking.
5. Client Responsibilities
By booking with us, clients agree to:
– Provide accurate and complete personal information.
– Ensure they have valid passports, visas, and any required travel documentation for entry into Cuba.
– Comply with local laws and regulations during their stay.
– Follow any health, safety, and environmental regulations applicable during the course of their visit.
6. DMC Responsibilities
Cubaism .com DMC will:
– Deliver services as outlined in the booking confirmation.
– Provide assistance in case of unforeseen changes or disruptions to booked services.
– Reserve the right to substitute services of equal or higher value if necessary, due to circumstances beyond our control.
We are not responsible for losses or damages resulting from circumstances outside our control, such as extreme weather events, government restrictions, or delays caused by third-party providers (e.g., airlines, hotels).
7. Force Majeure
In the event of a force majeure (natural disasters, pandemics, political unrest, etc.), Cubaism .com DMC reserves the right to alter or cancel services. We will attempt to reschedule services or provide equivalent alternatives when possible. Refunds may be issued at the company’s discretion, excluding non-refundable deposits.
8. Travel Insurance
We highly recommend that all clients purchase comprehensive travel insurance covering trip cancellations, medical emergencies, accidents, and personal belongings. Cubaism .com DMC is not liable for any costs or losses incurred due to insufficient or missing travel insurance.
9. Health and Safety
– Clients are responsible for ensuring they are in good health to travel and participate in the services booked.
– It is recommended that clients follow health advisories and obtain any required vaccinations.
– Cubaism .com DMC complies with Cuban health and safety regulations, but we are not liable for any health-related issues during the trip.
10. Data Protection and Privacy Policy
Cubaism .com DMC respects the privacy of our clients. Personal information collected during the booking process will only be used for the provision of services and will not be shared with third parties without consent, except where required by law. Clients have the right to access, correct, or request the deletion of their personal data by contacting sales@cubaism.uk or +53 55148056.
11. Changes to Terms and Conditions
Cubaism .com DMC reserves the right to update or modify these General Conditions at any time. Clients will be notified of any changes via the website or by email. Continued use of the website or our services after such changes will constitute acceptance of the new terms.
12. Governing Law and Jurisdiction
These General Conditions are governed by the laws of the Republic of Cuba. Any disputes arising from the use of our services or these terms will be subject to the exclusive jurisdiction of the Cuban courts.

14. Disclaimer
Cubaism .com DMC makes every effort to ensure the accuracy of the information on our website. However, we disclaim liability for services provided by third parties, such as hotels or transportation providers, which are beyond our direct control.
